Use of Property Areas for County of Orange Bikeway Project (“Notice of Motion for Prejudgment Possession from County of Orange”)

To Tenants of Amberwood Apartments and Los Coyotes Shopping Center:

The County of Orange is writing to provide clarification about information you received regarding the future OC Loop Bikeway project and how it relates to the Amberwood Apartments community and the Los Coyotes Shopping Center.

The County of Orange is in the planning phase for the future bikeway project in your area (construction is not expected to start for another two years). Earlier information you received (referred to as a “Notice of Motion for Prejudgment Possession”) is related to use of some areas of the Amberwood Apartments community and Los Coyotes Shopping Center as part of the future bikeway project.

About the Information you received earlier (Notice of Motion for Prejudgment Possession):

  • The County of Orange needs to use a portion of properties to construct the future bikeway.
  • Known as an “easement,” this involves using some areas -- either temporarily or permanently -- of a parking area or planting area located within the Amberwood Apartments community and Los Coyotes Shopping Center (see link below to map showing the easement locations)

What is not part of this easement process and future project:

  • The project does not propose taking possession of any portion of apartment homes or business locations. As stated above, only portions of parking areas and/or planting areas are being considered.

What is needed by you:

  • Only the owners of the Amberwood Apartments community and Los Coyotes Shopping Center (not individual tenants) are directly involved with this process.
  • As a tenant of the Amberwood Apartments community or Los Coyotes Shopping Center, you are not required to respond to the notice (information you received earlier). However, as a tenant, you have the right and may choose to respond and oppose the County’s request (“Motion for Prejudgment Possession”).

Upcoming public meeting:

The County of Orange is preparing to present more information and answer questions about the project at an upcoming community meeting in Buena Park. More information about the meeting will be provided in the coming days.
